Alternative Dispute Resolution

Any time people work together, marry, or just live together in a community, disputes will inevitably arise. The courts are clogged with people trying to litigate disputes. South Carolina has designated certain counties that include Richland County, as mandatory for Alternative Dispute Resolution (ADR) for all cases or as required by statute filed.

ADR is the many processes used to resolve disputes and manage conflict between parties outside of the court system. The goals are to resolve conflict out of the court system quicker and at a lower cost, allow participants to build a better relationship in the future and preserve the confidentiality of the participants.

Mediators and arbitrators are used in the process. A mediator is an impartial third person who helps two or more parties resolve their dispute or conflict Mediation is used almost universally in all courts for civil and family court issues. Arbitrators are also impartial hears both sides ad makes a decision. That decision, if properly filed with the court, can have the same weight and effect as a formal judgment.
