Family Law

Divorce was not legal in South Carolina until 1949-1950. That's right, there was no legal means of divorce until that time. Things have evolved and changed quite a bit since that time however. The South Carolina Family Court was established by statute in 1976. This court has exclusive jurisdiction over all matters involving family or domestic relationships including marriage, divorce, and child protection issues.

As the current debate over same-sex marriage shows, emotions run high when it comes to family and domestic issues. Family Court often attempts to resolve "high conflict" issues such as child abuse, child custody isssues, and mental health issues.

Family court also has exclusive jurisdiction over minors under the age of seventeen who have violated over the law.
